A 61-year-old man named Harvey Murphy Jr. has filed a lawsuit against Macy’s and EssilorLuxottica, the parent company of Sunglass Hut, for the wrongful use of facial recognition technology. Murphy claims that he was falsely identified as the perpetrator of an armed robbery at a Sunglass Hut store despite being thousands of miles away at the time.

Wrongful Identification and Legal Proceedings

According to the lawsuit filed by Murphy earlier this month, he was accused of committing armed robberies at both Sunglass Hut and Macy’s. However, Murphy asserts that he was incarcerated in Sacramento for unrelated charges during the time of the alleged robberies. Despite this, he was arrested and subjected to assault and mistreatment in prison before being released without charge.

Repercussions and Allegations

Murphy’s lawyers emphasize that their client, although with a criminal record dating back to the 1980s, has not been involved in violent offenses for the past three decades. They argue that Murphy has since rebuilt his life, making the false accusations and subsequent arrest all the more distressing.

The lawsuit alleges that EssilorLuxottica collaborated with Macy’s to employ facial recognition software to analyze surveillance footage of the robbery incidents. This led to Murphy’s wrongful identification and subsequent arrest when he visited the Department of Motor Vehicles (DMV) to renew his license.

Seeking justice for the physical and psychological trauma endured, Murphy is suing Macy’s, EssilorLuxottica, and three individuals involved in the case for $10 million in damages. The lawsuit highlights the pain and mental anguish caused by the false arrest and subsequent assault.
